Court recommends deportation of 768 Nepalis from US

In the first four months of 2025, 768 Nepalis have been recommended to the immigration court for deportation from the US. The US Immigration and Customs Enforcement (ICE) has recommended the court to finalize the deportation process for them, saying that they have been residing illegally.

According to data from the Executive Office for Immigration Review (EOIR), among those recommended to the court, 235 were in January, 239 in February, 194 in March and 100 in April. Data from May onwards has not been made public.

The EOIR stated that there is a provision for referral to the court for deportation if the US Citizenship and Immigration Services (USCIS) rejects the process for refugee or permanent residence, if the Temporary Protected Status (TPS) ends or if there is no immigration status. ICE has a provision to recommend to the court for removal orders those who enter the United States without a visa and request to stay and other people who violate immigration laws.

Not all those recommended to the court will be removed and some who complete the legal process may even receive green cards, according to the USCIS. “Some people who cannot obtain a green card will be ordered to be removed, and those who receive such orders must leave the United States,” the USCIS said. “This provision may not apply to immigrants who have been living in the United States illegally and without documents since entering the United States.”

President Donald Trump has tightened the policy of deporting immigrants who have been living in the United States illegally since he began his second term on January 20. Due to Trump’s strictness, 163 Nepalis have been deported in the six months since he began his term. From January to May, 146 men and 17 women were deported from the United States. The Trump administration deported 45 people in two batches by chartered flights and the rest by regular flights and handed them over to the Tribhuvan International Airport Immigration Office. 1,365 Nepalis were on the list to be deported. Of these, 163 have been deported.

During the tenure of former President Joe Biden, 8,910 Nepalis were issued ‘Notice to Appear’ and recommended to the court for deportation.
